This dissertation investigates the legal framework governing Public Private Partnerships (PPP) in Denmark and provides a definition for PPP. This definition contains three essential elements: private financing, project life cycle cost and risk sharing.
The dissertation questions the existing legal interpretation of subjecting the PPPs to the Executive order for municipalities for obtaining loans and granting of guarantees (Bekendtgørelse om kommunernes låntagning og meddelelse af garantier m.v.), including questioning the Danish deposit rule, which treats PPPs as a form of rental agreement.
